Terms of Service

1. Account Creation

Eligibility

You must be at least 16 years of age to create an account and use the Service. By registering, you represent that you meet this requirement.

Account Responsibilities

You are responsible for:

• Providing accurate and complete information during registration.
• Maintaining the security of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately at [email protected] if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that provide false information or are used in violation of these Terms.

One Account Per User

Each user may maintain one account. Creating multiple accounts to exploit the credit system, free tier, or promotional offers is a violation of these Terms and may result in termination of all associated accounts.

2. The Service

Copy Create is a web application that generates marketing and web copy using artificial intelligence. Users provide inputs through a guided brief process, and the Service generates written content based on those inputs, selected frameworks, voice styles, and readability levels.

Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

3. Credit System and Billing

How Credits Work

The Service operates on a credit-based system. Each content generation consumes a specified number of credits, displayed before generation. Credits are required to generate content.

• Free Credits — New accounts receive 50 free credits upon registration. No payment information is required to claim free credits.
• Purchased Credits — Additional credits can be purchased through the Service. Credit prices are displayed at the time of purchase.
• Subscription Plans — Subscription plans include a monthly credit allocation. Subscription credits reset at the beginning of each billing cycle and do not roll over to the next cycle unless explicitly stated in the plan terms.

Credit Consumption

Credits are consumed when content is successfully generated. If a generation fails due to a system error on our end, the credits for that generation will be refunded to your account. Credits are not refunded for generations that complete successfully, regardless of whether you are satisfied with the output.

Credit Expiration

• Free credits expire 12 months after account creation if unused.
• Purchased credits (one-time purchases) do not expire as long as your account remains active.
• Subscription credits reset monthly and unused subscription credits do not carry over.

Pricing

Credit and subscription prices are displayed on our pricing page and at the point of purchase. Prices are listed in USD unless otherwise stated. We reserve the right to change pricing with 30 days' advance notice for subscription plans.

Billing

Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. Subscription plans are billed on a recurring basis (monthly or annually) on the date of your initial subscription.

Taxes

Listed prices do not include applicable sales tax, VAT, or other government-imposed charges. Any applicable taxes will be added at checkout.

4. Content Ownership

Your Content

You own the content generated by the Service using your credits. This includes all text output produced through the guided brief process. You are free to use, modify, publish, and distribute your generated content for any lawful purpose, including commercial use.

Your Inputs

You retain ownership of all information you provide through the guided brief process (your briefs, business descriptions, and other inputs).

Our Rights

We do not claim ownership of your generated content or inputs. We retain a limited, non-exclusive license to process your inputs solely for the purpose of delivering the Service (generating your requested content). We do not use your inputs or generated content to train AI models, create derivative works, or share with other users.

No Exclusivity

The Service may generate similar or identical content for different users who provide similar inputs. We do not guarantee that generated content is unique or exclusive to you.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, obscene, or that promotes violence or discrimination.
• Generate content intended to deceive, defraud, or mislead others, including phishing content, fake reviews, or impersonation.
• Generate content that infringes on the intellectual property rights of any third party.
• Attempt to reverse-engineer, decompile, or extract the underlying AI models, prompts, or algorithms used by the Service.
• Circumvent or manipulate the credit system, including using automated tools to exploit the Service.
• Resell access to the Service or generated outputs as a competing content generation service.
• Use the Service in any way that could damage, disable, or impair the Service or interfere with other users.

We reserve the right to review content generation patterns and suspend or terminate accounts that violate these terms.

6. AI-Generated Content Disclaimers

All content produced by Copy Create is generated by artificial intelligence. You are solely responsible for reviewing, editing, and verifying all generated content before use.

Accuracy

Content generated by the Service is produced by artificial intelligence and may contain errors, inaccuracies, or outdated information. While our guided brief process and proven frameworks improve output quality, AI-generated content should always be reviewed by a human before publishing or distribution.

Legal Content

The Service offers generators for legal-adjacent content types (privacy policies, terms of service, cookie policies, refund policies). Generated legal content is a starting point, not legal advice. We strongly recommend having any legal content reviewed by a qualified attorney before publishing. Copy Create is not a law firm, does not provide legal services, and is not a substitute for professional legal counsel.

No Guarantee of Results

We do not guarantee that content generated by the Service will achieve any specific business outcome, including but not limited to: search engine rankings, conversion rates, customer engagement, or regulatory compliance.

7. Intellectual Property

The Service, including its design, code, guided brief workflows, content frameworks, branding, and documentation, is the intellectual property of Copy Create and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Copy Create shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including damages resulting from AI-generated content that is inaccurate, incomplete, or unsuitable for your intended purpose.
• Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid to Copy Create in the 12 months preceding the claim.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Copy Create, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service.
• Content you generate, publish, or distribute using the Service.
• Your violation of these Terms.
• Your violation of any third-party rights.

10. Termination

By You

You may delete your account at any time from your account settings. Upon deletion:

• Your account and personal information will be removed within 30 days.
• Your generated content will be permanently deleted.
• Unused purchased credits will be forfeited unless eligible for a refund under our Refund Policy.
• Active subscriptions will be cancelled, and you will retain access until the end of your current billing period.

By Us

We may suspend or terminate your account if:

• You violate these Terms.
• You engage in fraudulent or abusive behavior.
• Your account has been inactive for more than 24 months.
• Required by law or regulation.

We will provide reasonable notice before termination for inactivity and will attempt to notify you by email before terminating for Terms violations, except in cases of severe abuse.

11. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Copy Create is incorporated, without regard to conflict of law principles.

Informal Resolution

Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the matter informally within 30 days.

Binding Arbitration

If informal resolution fails, any dispute arising from or related to these Terms or the Service shall be resolved by binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction. Class action lawsuits and class-wide arbitration are not permitted.

12. Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Notify you by email at the address associated with your account.
• Post a notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree with the changes, you may delete your account before the new Terms take effect.

13. Miscellaneous

• Entire Agreement — These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Copy Create regarding the Service.
• Severability — If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• No Waiver — Our failure to enforce any provision does not constitute a waiver of that provision.
• Assignment — You may not assign your rights or obligations under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
